DMCA Notice & Takedown Procedure

My Way Carpet & Floors respects the intellectual property rights of others and expects users of our site to do the same. In accordance with the Digital Millennium Copyright Act of 1998 (17 U.S.C. §512), we will respond promptly to properly submitted notices of claimed copyright infringement.

Filing a Notice of Infringement

If you believe content on mywaycarpet.com infringes your copyright, send a written notice to our Designated Agent with the following:

1. A physical or electronic signature of a person authorized to act on behalf of the copyright owner.
2. Identification of the copyrighted work claimed to have been infringed (or a representative list).
3. Identification of the allegedly infringing material and the exact URL(s) where it appears on our site.
4. Your contact information: full name, mailing address, telephone number, and email address.
5. A statement that you have a good-faith belief that the use of the material is not authorized by the copyright owner, its agent, or the law.
6. A statement, made under penalty of perjury, that the information in the notice is accurate and that you are the copyright owner or authorized to act on the owner’s behalf.

Note: Knowingly making a false claim of infringement may subject you to liability under 17 U.S.C. §512(f), including damages, costs, and attorneys’ fees.

Counter-Notification

If your material was removed in response to a DMCA notice and you believe the removal was in error, you may file a written counter-notice to the same Designated Agent including:

1. Your physical or electronic signature.
2. Identification of the material removed and the URL where it previously appeared.
3. A statement, under penalty of perjury, that you have a good-faith belief the material was removed by mistake or misidentification.
4. Your name, address, phone number, and email.
5. A statement consenting to the jurisdiction of the federal district court for the judicial district in which your address is located (or, if outside the U.S., Middlesex County, New Jersey).
6. A statement that you will accept service of process from the complaining party.

On receipt of a valid counter-notice, we will forward it to the original complainant. If the complainant does not file an action for a court order within 10–14 business days, we may restore the material.

Repeat Infringers

We may, in our discretion, suspend or terminate access of users we determine to be repeat infringers of intellectual-property rights.
