Intellectual Property & Trademark Notice

This Intellectual Property Notice (the “Notice”) supplements our Terms of Service and describes the trademarks, trade dress, copyrights, and other intellectual property rights that protect mywaycarpet.com and the brands we display.

1. Our Trademarks & Trade Dress

The following are registered trademarks, service marks, and/or trade dress of My Way Carpet & Floors, used in commerce in the United States since 1998 (or as otherwise indicated):

• MY WAY CARPET® / MyWayCarpet.com® — the registered word marks for our retail and service brand.
• MY WAY CARPET FLOORS AND MORE® — the registered extended brand and dba mark.
• SAM THE CARPET MAN® — the registered word mark and character mark for the founder-spokesperson persona used in advertising, marketing, and showroom signage.
• 877-GO-MY-WAY jingle and audio mark — the recorded jingle used in advertising.
• The MWC rectangular logo, the navy-and-gold logo lockup, and the showroom-front signage and storefront treatment — collectively, our trade dress.
• Marketing taglines including (without limitation) “Floors and More,” “Showroom Available — By Appointment Only,” and “Anderson Tuftex Authorized Dealer Worth Driving To.”

Common-law trademark rights apply to any unregistered marks above. Use of any of these marks in commerce without our written authorization, or in a way likely to cause confusion as to source, sponsorship, affiliation, or endorsement, is prohibited.

2. Our Copyrighted Works

The site, taken as a whole and in its constituent parts, is an original compilation and creative work. We claim copyright in:

• All original text, including service descriptions, town and county landing pages, blog articles, FAQ content, binding-stitch explainers, and the wide-binding article.
• All original photography taken by or commissioned by My Way Carpet & Floors, including showroom photos, installation photos, before/after photos, and project case studies.
• The selection, arrangement, and curation of catalog data — including our scoring, mood/fiber/use classification system, color-family taxonomy, and compare-board feature.
• The site’s HTML, CSS, JavaScript, and Python generators developed by or for My Way Carpet & Floors.
• Original audio, jingles, and video assets produced for My Way Carpet & Floors.

Copyright is reserved in the name of My Way Carpet & Floors. Use of any copyrighted work without prior written permission is prohibited except as expressly permitted by U.S. copyright law (e.g., fair-use commentary, accessibility tools, search-engine indexing).

3. Brand Color Scheme & Design Elements

Our distinctive brand and trade dress includes, without limitation:

• The navy + gold + cream palette — specifically the navy values #0A2940 / #102536, the gold values #C8A85F / #FFC72C, and the cream value #F6F1E5 — as applied to our retail and digital marketing materials.
• The navy-on-white grid layout with gold accent rules, gold uppercase kicker labels, and red call-to-action buttons.
• The footer’s multi-column links + branded contact card arrangement.
• The floating “Book Showroom” pill and “View Catalog” pill design.
• Section heading patterns (gold kicker over navy headline) and our distinctive testimonial-card styling.

Imitation of this color palette, layout, or visual identity in a way likely to cause confusion with our brand — or that creates a competing carpet/flooring retailer site in the same market — may constitute trade-dress infringement and unfair competition. We will pursue available remedies for material infringement.

4. Our Custom Catalog & Compare-Board Interface

Our live brand catalog — including the multi-tier image presentation, the filter taxonomy (mood, fiber, use, color family), the color-card view behavior, the cross-brand compare board, the magnifying-glass zoom lightbox, and the hash-routing pattern (#style=&color=) — is an original interactive work created by or for My Way Carpet & Floors. It is protected as a copyrighted compilation and software work. Cloning, mirroring, or substantially copying its structure or behavior is prohibited.

5. Photography & Watermarks

Catalog images that appear on the site are either:

• Photography supplied by the relevant manufacturer (Anderson Tuftex, Masland, Kane Carpet, Shaw, COREtec, Fabrica, etc.), used here under our authorized dealer relationship and with attribution; or
• Photography taken by or commissioned by My Way Carpet & Floors.

Many catalog images carry a faint “mywaycarpet.com” corner watermark identifying our presentation. Removing, obscuring, or altering this watermark is prohibited and may constitute trademark infringement, copyright-management-information violation under 17 U.S.C. §1202, or unfair competition.

6. Third-Party Manufacturer Trademarks

We mention and display the following third-party brands as an authorized retailer. All trademarks, service marks, product names, and logos remain the property of their respective owners:

• ANDERSON TUFTEX® — a brand of Shaw Industries Group, Inc.
• SHAW®, SHAW FLOORS®, ANSO® — Shaw Industries Group, Inc.
• MASLAND® — a brand of The Dixie Group, Inc.
• FABRICA® — a brand of The Dixie Group, Inc.
• KANE CARPET™ — Kane Carpet Co.
• COREtec® — a brand of Shaw Industries Group, Inc.
• Other brand names referenced on the site — respective owners.

Reference to these marks does not imply ownership of those marks by My Way Carpet & Floors or any endorsement by those owners other than our authorized dealer relationships.

7. Prohibited Uses

Without our prior written consent, you may not:

• Scrape, copy, mirror, or systematically download any portion of the site;
• Train, fine-tune, or build a dataset for a machine-learning model from any portion of the site;
• Use any of our trademarks, color scheme, layout, or trade dress in advertising, listings, social-media profiles, or competing websites;
• Frame or embed the site in another site or app;
• Remove watermarks or attribution from any image on the site;
• Use the site for keyword bidding or domain registration designed to divert traffic from us.

8. Reporting Infringement (DMCA & Trademark)

If you believe any content on our site infringes your copyright or trademark, please send a written notice to our designated agent containing the following information:

1. A physical or electronic signature of a person authorized to act on behalf of the owner of the right.
2. Identification of the copyrighted work or trademark claimed to be infringed.
3. The exact URL(s) of the alleged infringement.
4. Your contact information (full name, address, phone, email).
5. A statement that you have a good-faith belief that the use is not authorized.
6. A statement, under penalty of perjury, that the information is accurate and that you are authorized to act.

9. Counter-Notice Procedure

If material you posted has been removed and you believe it was removed in error, you may file a written counter-notice containing:

1. Your physical or electronic signature.
2. Identification of the material and its prior location.
3. A statement, under penalty of perjury, that you have a good-faith belief the material was removed by mistake or misidentification.
4. Your name, address, phone, and consent to jurisdiction in the federal court for your address (or, if outside the U.S., Middlesex County, New Jersey).

10. Repeat-Infringer Policy

We terminate, in appropriate circumstances, the accounts or access of users who are determined to be repeat infringers of intellectual-property rights.

11. Authorized Use & Press Inquiries

For licensing, press, partnership, or other authorized uses of our brand assets, contact press@mywaycarpet.com. Authorized press use of our logo and brand photos is granted on request for editorial coverage of My Way Carpet & Floors.
